Terms and Conditions
Morgan & Co. Travel LLC (operated by Morgan Heintzen) provides travel planning and booking
services.
The terms and conditions below apply to your purchase and booking of any travel service,
including but not limited to flights, travel insurance, accommodations, tours, transportation,
cruises, and other travel-related services.
Please read these Terms and Conditions carefully. By making a booking through Morgan & Co.
Travel LLC, you acknowledge that you have read, understand, and agree to these Terms and
Conditions.
You must be at least 18 years of age to make a booking.
The person making the booking warrants that they have the authority to accept these Terms and
Conditions on behalf of all travelers listed on the booking. The primary traveler will be
responsible for communicating these terms to all travelers and will have authority over the
booking, including amendments and cancellations.
1. Agency Relationship
Morgan & Co. Travel LLC acts solely as an agent for travel suppliers, including but not limited
to airlines, hotels, cruise lines, tour operators, transportation providers, and travel insurance
providers.
All travel services are provided by independent third-party suppliers. Morgan & Co. Travel LLC
is responsible only for arranging travel services and is not responsible for the acts, omissions,
negligence, or failures of any supplier.
If a travel supplier fails to provide services, or if the services provided are unsatisfactory, your
remedy is solely with the travel supplier and not with Morgan & Co. Travel LLC.
Payments made to Morgan & Co. Travel LLC are transmitted to suppliers to secure travel
arrangements and are not held in trust.
2. Independent Contractor
Morgan & Co. Travel LLC is owned and operated by Morgan Heintzen. Morgan Heintzen
operates as an independent contractor. Travel arrangements are made on behalf of clients with
independent suppliers and are not contracts with any host agency or affiliate.
3. Limitation of Liability
Morgan & Co. Travel LLC shall not be liable for any injury, loss, damage, delay, inconvenience,
or expense arising from:
acts or omissions of travel suppliers
mechanical breakdowns
government actions
weather events
labor disputes
airline schedule changes
delays or cancellations
or any other events beyond our control
Morgan & Co. Travel LLC does not guarantee the performance or quality of services provided
by travel suppliers.
Where liability cannot legally be excluded, the maximum liability of Morgan & Co. Travel LLC
shall not exceed the amount paid for the travel services arranged.
4. Force Majeure
Morgan & Co. Travel LLC shall not be liable for any failure or delay in performance resulting
from events beyond its reasonable control, including but not limited to:
acts of God
natural disasters
pandemics or public health emergencies
government actions or travel restrictions
war or terrorism
civil unrest
airline cancellations
weather disruptions
strikes or labor disputes
Refunds or credits in these situations are subject to the policies of the suppliers.
5. Rates, Pricing & Price Changes
Travel prices are subject to change until payment is received and confirmed. Prices may change
due to circumstances outside our control, including:
currency fluctuations
fuel surcharges
taxes
supplier price changes
government-imposed fees
If a supplier increases the price after booking, the additional amount may be payable by the
client.
Morgan & Co. Travel LLC is not responsible for supplier price increases.
6. Price Drop Policy
Travel prices fluctuate frequently. Morgan & Co. Travel LLC does not guarantee price
adjustments if the price of a travel product decreases after booking. If a price reduction occurs
and the supplier allows adjustments without penalty, Morgan & Co. Travel LLC may assist in
requesting the adjustment; however, price drops are subject solely to supplier policies.
7. Reservations
All reservations are subject to confirmation by the travel supplier. If a booking cannot be
confirmed, clients will be offered alternative arrangements or a refund where permitted by the
supplier.
Morgan & Co. Travel LLC is not responsible for additional costs incurred as a result of such
changes.
8. Deposits, Payments & Final Payment
A deposit may be required to secure travel arrangements. Deposit amounts vary depending on
the supplier and travel product.Deposits are non-refundable unless otherwise stated by the supplier.
Final payment deadlines are determined by the supplier. Failure to pay by the deadline may
result in cancellation of the booking. Morgan & Co. Travel LLC is not responsible for
cancellations due to missed deadlines.
9. Client Changes & Cancellations
You may request cancellations or amendments by contacting Morgan & Co. Travel LLC in
writing.
Suppliers may impose charges for cancellations or amendments, up to 100% of the service
cost. Refunds will be passed on if and when received from the supplier.
Morgan & Co. Travel LLC may charge additional service fees for any amendments,
processing, or urgent requests.
10. Travel Insurance
Travel insurance is strongly recommended. Clients who decline insurance assume all
financial risk associated with cancellations, interruptions, medical emergencies, supplier
defaults, or other travel disruptions.
Morgan & Co. Travel LLC may provide general information but does not provide insurance
advice.
11. Travel Documentation
Clients are responsible for ensuring all travel documents are valid, accurate, and in compliance
with all applicable laws and supplier requirements.
Incorrect names, dates, or details may result in cancellations.
Any fees to reissue or resend documents are the client’s responsibility.
12. Passports & Visas
Clients must have valid passports and any required visas, permits, or documentation. Morgan &
Co. Travel LLC is not responsible for fines, penalties, or additional costs arising from improper
travel documents.
13. Airline Schedule Changes
Airlines may reschedule or cancel flights at any time. Clients are responsible for confirming
flight times prior to travel. Morgan & Co. Travel LLC is not responsible for additional costs
incurred due to schedule changes.
14. Supplier Financial Default
Morgan & Co. Travel LLC is not responsible for the financial failure or bankruptcy of any
supplier, including airlines, hotels, cruise lines, or tour operators.
15. Client Responsibility
Clients must review all travel documents, itineraries, and confirmations immediately and report
any errors within 24 hours. Clients are responsible for:
travel schedules
itinerary accuracy
special requirements (seating, meals, accessibility)
Morgan & Co. Travel LLC is not liable for issues arising from client inaction.
16. Credit Card Chargebacks
By providing payment information, the client agrees not to initiate chargebacks for services
properly rendered. If a dispute arises, the client agrees to reimburse Morgan & Co. Travel LLC
for any fees, penalties, or costs incurred.
17. Professional Planning & Service Fees
Morgan & Co. Travel LLC may charge fees for consultation, itinerary design, research, booking,
and management. These fees are non-refundable and will be disclosed prior to being charged.
18. Travel Risks
Travel involves inherent risks including illness, injury, delays, disruptions, and loss. By booking
through Morgan & Co. Travel LLC, clients acknowledge and accept these risks.
19. Governing Law & Arbitration
These terms are governed by the laws of the State of Texas. Any disputes will be resolved
exclusively by binding arbitration in Ellis County, Texas, or another mutually agreed location in
Texas.
By agreeing to these terms, clients waive their rights to file a lawsuit, demand a jury trial, or
pursue litigation. Each party shall bear its own legal fees unless otherwise determined by the
arbitrator.
